Terms of Service
These Terms of Service ("Terms") govern your purchase and use of website design and build services (the "Services") offered by DYNODE LLC ("Dynode," "we," "us") through worlds.dynode.ai (the "Site"). By placing an order or submitting the order form, you agree to these Terms on behalf of yourself or the business you represent.
1. The Services
We design and deliver one-page cinematic scroll websites in three packages — Starter, Signature, and Bespoke — as described on the Site at the time of your order. Each package includes AI-generated imagery, scroll-driven motion, written copy, a mobile version, and the number of remark rounds stated for that package. The Site's package descriptions at the time of purchase form part of your order.
2. Ordering, payment, and the brief
- Orders are placed through the Site's order form and paid in full, in advance, via our payment processor (Stripe). We never see or store your card details.
- Your brief is complete when we have received both your payment and the brand materials we request by email (name, links, and any content you want included). Delivery windows run from brief completion, not from payment alone.
- We may decline or refund any order at our discretion before production starts (for example, where the subject matter is unlawful, infringing, or outside what our process can deliver well).
3. Delivery
- Starter: target delivery within 48 hours of a completed brief.
- Signature and Bespoke: these carry additional sections, visuals, and finishing and can take longer than 48 hours — but no more than 5 days from a completed brief.
- Builds are fulfilled sequentially, first come, first served. Delivery targets are made in good faith but are not guaranteed times; delays caused by incomplete briefs, slow responses, or third-party outages extend the window accordingly.
4. Remark rounds and acceptance
- After delivery you may request changes in batched "remark rounds": one round (Starter), two rounds (Signature), or three rounds (Bespoke). A round is a single consolidated list of requested changes within the original scope of the package.
- Remark rounds must be requested within 30 days of delivery. New scope (additional pages, new sections beyond the package, new imagery themes) is not a remark round and may be quoted separately.
- The work is deemed accepted when you approve it, when your included remark rounds are exhausted, or 14 days after delivery with no response — whichever comes first.
5. Refunds
- You may cancel for a full refund any time before production starts (production starts when we begin generating assets for your brief).
- After production has started, payments are non-refundable, except that if we fail to deliver your build within the stated maximum window (and the delay is not caused by an incomplete brief or your unresponsiveness), you may choose a full refund instead of delivery.
- Dissatisfaction with subjective aesthetics is addressed through your included remark rounds, not refunds.
6. Your content and your warranties
You are responsible for the materials you provide (names, logos, links, text, images) and you warrant that you have the rights to use them and that they are lawful, accurate, and do not infringe any third party's rights. You are solely responsible for the claims your website makes about your own business, products, prices, and services, and for your website's compliance with the laws and regulations that apply to your business. You agree to indemnify DYNODE LLC against claims arising from materials you supplied or from your use of the delivered website.
7. AI-generated content
Our visuals and copy are produced with the assistance of generative AI tools and are curated by us. You acknowledge that: (a) AI-generated imagery is synthetic and may resemble other generated content in style; (b) we do not warrant that generated content is registrable as a trademark or protectable by copyright in every jurisdiction; and (c) it is your responsibility to clear any trademark or brand-conflict concerns for your market before use.
8. Ownership and license
- Upon full payment and delivery, you receive ownership of your website's deliverables — the final site files, imagery, and copy created for your brand — to the fullest extent we are able to convey rights in AI-assisted work.
- We retain ownership of our underlying tools, processes, code libraries, and the scroll engine, which are licensed to you as embedded in your delivered site, for use with that site.
- We may display the delivered work in our portfolio and marketing (with your brand shown) unless you request otherwise in writing at or before delivery.
9. Hosting and third-party services
We do not host your website and charge no recurring fees. Starter includes a written self-hosting guide; Signature and Bespoke include hands-on setup of hosting and your domain in accounts that you own. You are responsible for your hosting provider's fees and terms, your domain registration, and anything that happens to the site after handover (including edits made by others). We are not responsible for the availability, performance, or policies of third-party services, including hosting providers, domain registrars, Stripe, or analytics providers.
10. Disclaimer of warranties
Except as expressly stated in these Terms, the Services and deliverables are provided "as is." We disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any particular business outcome — including traffic, rankings, conversions, or sales — from your website.
11. Limitation of liability
To the maximum extent permitted by law: (a) DYNODE LLC's total aggregate liability arising out of or related to the Services shall not exceed the amount you paid us for the order giving rise to the claim; and (b) we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, even if advised of the possibility. Nothing in these Terms limits liability that cannot be limited by law.
12. Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, including outages of AI-generation providers, hosting platforms, or payment infrastructure. Delivery windows are extended by the duration of such events.
13. General
- These Terms are the entire agreement for your order and supersede prior discussions.
- We may update these Terms prospectively; the version in force when you order applies to that order.
- If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver.
- These Terms are governed by the laws of the jurisdiction in which DYNODE LLC is organized, without regard to conflict-of-law rules, and disputes shall be resolved in the courts of that jurisdiction.
